1. Introduction and Acceptance

Welcome to AbieMarket. These Terms and Conditions ("Terms") govern your access to and use of the AbieMarket website and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use our Services.

2. Definitions

  • "Platform" refers to the AbieMarket website and all associated services

  • "User," "You," and "Your" refer to individuals accessing our Services

  • "We," "Us," and "Our" refer to AbieMarket and its affiliates

  • "AbieMarket" operates the Platform, collects payment from you as agent for the Vendor, may arrange delivery, and provides the AbieMarket Guarantee. AbieMarket is not the seller of the goods.

  • "AbieMarket Guarantee" means the commercial promise described in section 9.

  • "Review Period" means the period after delivery during which you may report a problem with your order. It is 3 calendar days from delivery, and the period that applies to your order is also shown on the order itself.

  • "Content" refers to text, images, videos, and other materials on our Platform

  • "Vendor" means an independent business that sells goods through the Platform. The Vendor, not AbieMarket, is the seller of the goods you buy.

  • "Buyer" refers to customers who purchase products through our Platform

  • “Fulfillment” means the storage, packaging, delivery, or coordination of product delivery, which may be performed by AbieMarket directly or through authorized logistics partners.

3. Eligibility

To use our Services, you must:

  • Be at least 18 years of age or the age of majority in your jurisdiction

  • Have the legal capacity to enter into binding contracts

  • Not be prohibited from using our Services under applicable laws

  • Provide accurate and complete information when creating an account

4. Account Registration and Security

When you create an account, you agree to:

  • Provide accurate, current, and complete information

  • Maintain and promptly update your account information

  • Maintain the security and confidentiality of your account credentials

  • Notify us immediately of any unauthorized access or security breach

  • Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our sole discretion.

5. Permitted Use and Restrictions

5.1 Permitted Use

You may use our Services for lawful purposes in accordance with these Terms.

5.2 Prohibited Activities

You agree not to:

  • Violate any applicable laws or regulations

  • Infringe upon the intellectual property rights of others

  • Upload or transmit viruses, malware, or malicious code

  • Attempt to gain unauthorized access to our systems or networks

  • Engage in any form of harassment, abuse, or harmful behavior

  • Use automated systems (bots, scrapers) without our written permission

  • Interfere with the proper functioning of the Platform

  • Impersonate any person or entity

  • Engage in fraudulent activities or misrepresentation

  • Collect or harvest user information without consent

6. Intellectual Property Rights

6.1 Our Content

All content on the Platform, including but not limited to text, graphics, logos, images, software, and design, is the property of AbieMarket or its licensors and is protected by copyright, trademark, and other intellectual property laws.

6.2 User Content

When you submit content (reviews, listings, messages), you:

  • Retain ownership of your content

  • Grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content

  • Represent that you have the right to submit the content

  • Agree that your content does not violate any third-party rights

6.3 Trademarks

"AbieMarket" and related logos are trademarks of AbieMarket. You may not use our trademarks without our prior written permission.

7. Commercial Terms

7.1 Purchases, Payments, and Settlement

When you buy on the Platform, your contract of sale is with the Vendor. AbieMarket collects your payment as agent for the Vendor. Paying AbieMarket discharges what you owe the Vendor for that order.

AbieMarket holds the money until your order has been delivered and the Review Period has passed. Holding the payment is how the Platform protects you: if the order never arrives, the money has not gone to the Vendor.

After delivery you have the Review Period to report a problem. If you report no problem within it, the funds are released to the Vendor and the transaction is final.

AbieMarket reserves the right to refuse, cancel, or limit transactions at its discretion, including in cases of suspected fraud, pricing errors, or policy violations.

7.2 Vendor Terms

  • Vendors must comply with all applicable laws and regulations

  • Vendors are responsible for accurate product descriptions and pricing

  • Vendors must fulfill orders in a timely manner

  • Platform fees and commission structures will be detailed in separate vendor agreements

7.3 Shipping, Returns, and Refunds

You may request a refund within the Review Period after delivery, from the order in the app.

The Vendor decides your refund request in the first instance. You will see in the app whether the store has accepted or declined it.

If the Vendor declines your request, or does not respond within 3 calendar days of you making it, you may escalate the request to AbieMarket under the AbieMarket Guarantee in section 9.

Once the review period expires and funds are released to the vendor, the transaction becomes final and goods are non-refundable, except where required by applicable consumer protection laws.

AbieMarket reserves the right to deny refund requests that fall outside the review period or do not meet eligibility criteria.

8. Marketplace Structure and Seller Representation

AbieMarket operates an online marketplace. The goods offered on the Platform are sold by independent Vendors, and the Platform shows you which store each product comes from.

Your contract of sale is with the Vendor, not with AbieMarket. The Vendor is responsible for the goods it sells — for describing them accurately, for their condition and quality, for their legality, and for any harm they cause.

What AbieMarket does. AbieMarket provides and operates the Platform, collects your payment as agent for the Vendor and holds it as described in 7.1, arranges delivery where AbieMarket offers fulfilment, provides customer support for orders placed on the Platform, and operates the AbieMarket Guarantee described in section 9.

Dealing only through the Platform. Naming a store is not an invitation to deal with it privately. Vendors are required not to contact you directly outside the Platform, not to include their own contact details or off-platform ordering instructions in packaging or materials, and not to sell to you outside the Platform. Orders arranged outside the Platform are not covered by these Terms, are not protected by the payment holding in 7.1, and are not covered by the AbieMarket Guarantee.

Raise any problem with an order through the Platform, so that it is recorded and so that the protections in these Terms apply to it.

9. The AbieMarket Guarantee

The Vendor is the seller and is responsible for its goods. The AbieMarket Guarantee exists so that you are not left out of pocket when a Vendor does not put things right.

What it covers. A claim qualifies if:

  • the item never arrived;

  • the item is materially different from its listing; or

  • the item was faulty when it arrived.

What it does not cover. Changing your mind, damage or loss occurring after the item was delivered to you, items we do not permit to be sold on the Platform, and anything bought or arranged outside the Platform.

How to claim. Raise the problem with the Vendor first, by requesting a refund from the order in the app. If the Vendor declines, or does not respond within 3 calendar days, escalate the claim to AbieMarket from the same order.

Time limit. You must claim within 3 calendar days of delivery, or of the date the item should have been delivered where it never arrived.

Limit on value. There is no upper limit. The AbieMarket Guarantee is not subject to a maximum claim value — whatever you paid for a qualifying order, that is what AbieMarket will refund you.

What we do. If your claim qualifies, AbieMarket pays you the amount due, in the currency you paid in. We may ask you for photographs or other evidence, and we may ask you to return the item before paying. AbieMarket then recovers the amount from the Vendor.

What this is. The AbieMarket Guarantee is a commercial promise by AbieMarket to its customers. It is not insurance, it is not backed or underwritten by any third party, and it does not reduce or replace any right you have against the Vendor or under applicable consumer protection law. Where you have such a right, you may pursue it instead of, or after, a claim under this Guarantee.

10. Fulfillment and Delivery

AbieMarket may offer fulfillment services on behalf of vendors who opt into AbieMarket-managed fulfillment.

When fulfillment is managed by AbieMarket, AbieMarket is responsible for coordinating packaging, delivery, and customer communication related to the order.

Delivery timelines are estimates and may vary based on location, availability, and logistics conditions.

AbieMarket is not responsible for delays or failures caused by events beyond its reasonable control, including but not limited to weather, third-party logistics issues, or force majeure events.

11. Disclaimers and Limitations

11.1 "As Is" Basis

Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

11.2 Third-Party Content

We are not responsible for the accuracy, legality, or content of third-party websites linked from our Platform or content provided by users.

AbieMarket does not facilitate or permit direct communication or transactions between customers and vendors outside the Platform.


11.3 Customer Relationship

By completing a purchase on the Platform, you acknowledge that your contract of sale is with the Vendor and not with AbieMarket. AbieMarket acts as the Vendor’s agent for collecting your payment, and as guarantor under the AbieMarket Guarantee in section 9.

12. Limitation of Liability

AbieMarket provides the Platform. It does not make, inspect or select the goods sold on it, and it is not the seller of those goods. Except for what AbieMarket promises under the AbieMarket Guarantee in section 9, and for AbieMarket’s own acts and omissions in operating the Platform, arranging delivery where it offers fulfilment, and handling your payment, responsibility for the goods rests with the Vendor.

To the fullest extent permitted by law, AbieMarket and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from:

  • Your use or inability to use our Services

  • Unauthorized access to or alteration of your data

  • The conduct of a Vendor, or the goods a Vendor sells

  • Third-party conduct or content on the Platform

  • Any other matter relating to our Services

Our total liability to you shall not exceed the greater of the amount you paid for the order to which the claim relates, or the amount payable to you under the AbieMarket Guarantee in respect of that order.

Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law.

13. Indemnification

You agree to indemnify, defend, and hold harmless AbieMarket and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of our Services

  • Your violation of these Terms

  • Your violation of any third-party rights

  • Your content or conduct on the Platform

14. Termination

We reserve the right to suspend or terminate your access to our Services at any time, with or without cause, and with or without notice, for any reason including:

  • Violation of these Terms

  • Fraudulent or illegal activity

  • Extended periods of inactivity

  • At our sole discretion for operational reasons

Upon termination, your right to use the Services will immediately cease. Provisions that by their nature should survive termination shall survive.

15. Dispute Resolution and Governing Law

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which AbieMarket is registered, without regard to its conflict of law provisions.

15.2 Dispute Resolution

Any disputes arising from these Terms or your use of our Services shall first be addressed through good faith negotiations. If unresolved, disputes may be subject to binding arbitration or litigation in accordance with applicable laws.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of our Services after changes constitutes acceptance of the modified Terms.

17. General Provisions

  • Entire Agreement: These Terms constitute the entire agreement between you and AbieMarket regarding your use of our Services

  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in effect

  • Waiver: Our failure to enforce any right or provision shall not constitute a waiver of such right or provision

  • Assignment: You may not assign these Terms without our written consent. We may assign these Terms at our discretion

  • Force Majeure: We shall not be liable for any failure to perform due to circumstances beyond our reasonable control
